The terms governing the rental of sports equipment by PT Monta Tolotangga Resort.
These terms govern rental agreements between PT Monta Tolotangga Resort ("we", "us"), an Indonesian company, and the client ("you").
Each rental is confirmed by a written agreement specifying equipment, duration, fees and delivery terms. The agreement and these terms form the entire contract.
All equipment remains the property of PT Monta Tolotangga Resort. Title never transfers. Equipment may not be sold, sublet, or permanently disposed of.
Equipment travels under ATA Carnet for temporary admission. You agree to cooperate with return of the equipment so it may be re-exported within the permitted period.
Rental fees are invoiced in EUR or USD and payable by international bank transfer to our Indonesian account before delivery.
Transit and in-use insurance is included in the rental. You remain responsible for equipment beyond fair wear and tear as set out in the rental agreement.
Equipment must be used only for its intended sporting purpose and in accordance with safety instructions. You are responsible for using equipment safely and lawfully.
Cancellation terms are set out in the rental agreement and depend on notice given before the rental start date.
To the maximum extent permitted by law, our liability is limited to the rental fees paid, except where caused by our gross negligence.
These terms are governed by Indonesian law. Disputes shall be resolved by arbitration, with the parties agreeing to a neutral venue.
